2026 – New Year, New Laws
I hope that everyone had a wonderful Christmas and New Year. Rain and snow throughout Spain has left many towns and rivers flooded in the south and blankets of snow in the north.
In addition to driving carefully, for those that are not already aware, there is a new law effective from 1st January 2026 which makes it obligatory to carry the new Baliza V16 (flashing beacon) in case of emergencies and road side assistance.
There is a grace period of 3 months, but after April 2026, police will start handing out fines for anyone not carrying a working unit in their vehicle. The beacon replaces the previously obligatory reflective triangle. These can be bought on Amazon or other leading retailers.
The unit is placed on top of your vehicle, eliminating the need for you to step outside the car, hence reducing roadside accidents. It connects to public traffic systems alerting authorities, and other drivers, and they “assure” us that no private data is sent.
Andalucian Rental licence restrictions
In December 2025, the Junta de Andalucia approved the new decree (9/2025) which follows in the footsteps of the Royal decree at national level (5/2024) restricting further the properties that can be rented on short term tourist lets.
The Andalucian regulations place an indefinite pause on the short term rental of any property that does not have an independent entrance, and that falls within any town/city where tourist lets are more than 15% of the total housing in the municipality, basically eliminating any apartment or room lets.
Think of it as a two-layer system:
Layer 1 (National – RD 5/2024): Every tourist rental in Andalusia must first comply with these rules (e.g., registration in the national registry).
Layer 2 (Regional – Decree 9/2025): On top of the national rules, the property must also comply with Andalusian-specific rules (e.g., the private entrance requirement and being in a municipality that hasn’t hit the 15% cap).
Practical Example: A property owner in Seville must:
Register in the National Registry (mandated by RD 5/2024) AND
Ensure their property has a private entrance and that the city of Seville hasn’t exceeded the 15% cap to get a new license (mandated by Decree 9/2025).
Any property that already has the licence can continue to rent, but the new laws effectively ban any new rental properties. It looks like only urban villas with occupation licences are the only ones that escape this restriction (15% rule permitting).
Official figures are not yet published as to which towns are above/below the 15% cap. This will perhaps be notified once the statistics have been established, and will be determined by each town/municipality which issues the licences.
Joke of the Month:
A man visits a monastery where monks have taken a vow of silence.
They’re allowed to speak only two words every ten years.
After ten years, the head monk asks the man,
“What are your two words?”
“Bed hard.”
Ten more years pass.
The monk asks again,
“What are your two words?”
“Food bad.”
Another ten years go by.
“What are your two words?”
“I quit.”
The head monk nods and says,
“I’m not surprised.
You’ve done nothing but complain since you got here.”
